Frequently Asked Questions

Clear, straightforward answers regarding process, safety, tax treatment, and liquidity.

What is the difference between Physical Possession and Symbolic Possession?+

Symbolic Possession means the bank has legal right on paper, but the borrower or tenant still physically occupies the property. Physical Possession means the bank has physically evicted the borrower with court/magistrate assistance and holds the actual physical keys. MFeasy strongly recommends bidding only on Physical Possession properties.

What is the payment timeline after winning an auction bid?+

As per SARFAESI rules: (1) You deposit 10% EMD to participate, (2) If you win, you must pay another 15% immediately (total 25% on the auction day), and (3) The remaining 75% balance must be paid within 15 days (extendable up to 90 days with bank written approval).

Who is responsible for past unpaid electricity, society, or municipal dues?+

Properties are typically sold on an 'As is where is' basis. While banks recover loan dues, past municipal property tax or society dues may attach to the property. Our legal due diligence identifies these liabilities prior to bidding so you factor them into your bid calculation.

Can the original defaulting borrower challenge the auction in court?+

Borrowers can appeal to the Debt Recovery Tribunal (DRT) under Section 17 within 45 days. However, recent Supreme Court rulings have severely restricted frivolous appeals once the bank completes proper procedure and issues the statutory Sale Certificate.

Regulatory Disclosure & Risk Notice: Bank auction properties are sold by financial institutions under the SARFAESI Act, 2002 or Insolvency and Bankruptcy Code (IBC) on an 'As is where is, whatever there is' basis. Acquisition involves strict settlement timelines and potential legal delays. KS Finoleg Services Pvt Ltd (MFeasy) provides legal research, property due diligence, and advisory facilitation.
